Two students have filed a leave to appeal against the High Court's verdict declaring the circular cancelling the quota system in the first- and second-class government jobs illegal.
Advocate Shah Monjurul Hoque filed the leave to appeal on behalf of the two students in the relevant branch of the Appellate Division on Thursday.
Earlier, the state party also filed a leave to appeal against the High Court's verdict declaring the circular cancelling the quota system in the first- and second-class government jobs illegal. The leave to appeal seeks to quash the judgment of the High Court and was filed in the Appellate Division on Tuesday.
On July 14, the full verdict of the High Court declaring the circular to cancel the quota system in the first- and second-class government jobs, including for freedom fighters, was published.
A High Court bench comprising Justice KM Kamrul Kader and Justice Khizir Hayat issued the full 27-page judgment.
The judgment mentioned that in view of the order given by the High Court in response to a writ filed in 2012, and the order upheld and amended by the Appellate Division in 2013, the government was directed to restore the quota for the children and grandchildren of freedom fighters.
Additionally, it was directed to maintain quotas for districts, women, persons with disabilities, and tribal minorities, if any.
The circular was to be issued within three months of the order.
The High Court also noted that the judgment would not prevent the defendants from changing the quota and adjusting the rates for the said categories. The government retains the liberty to fill vacant posts from the general merit list if the quota is not met in any public examination.
Following the verdict, Deputy Attorney General Sheikh Md Saifuzzaman said that on July 10, the Appellate Division had ordered to maintain the status quo regarding the quota. The Appellate Division has fixed the date of the hearing for August 7. As a result, the judgment of the High Court will not be effective for the time being.
On June 5, the High Court declared illegal the circular that cancelled the quotas, including those for freedom fighters, in first and second-class government jobs.
As a result, the 30% quota for freedom fighters in government jobs (grades 9 to 13) will remain in place.
On October 4, 2018, the Ministry of Public Administration issued a circular to implement the cabinet's decision to abolish the existing quota system for direct recruitment to first and second-class posts in government jobs.
The Ministry of Public Administration issued the circular a day after the decision of the Cabinet to cancel the quota.
The government decided to remove the 45% quota for recruitment in government jobs from ninth to thirteenth grade, opting for merit-based recruitment after a prolonged student movement demanding quota reform. The quota review committee's recommendations led to this decision, approved during a cabinet meeting chaired by Prime Minister Sheikh Hasina on October 3, 2018.
