Sikder Group Managing Director Ron Haque Sikder and his brother Dipu Haque Sikder -- both accused of threatening to shoot and torture two top officials of Exim Bank over a loan -- have filed an anticipatory bail petition with the High Court.
On July 2, Ron and Dipu, who are now staying in Thailand, had filed the bail plea.
The bail petition is the first item on the daily cause list of July 20 for the bench of Justice Md Ashraful Kamal, with the hearing set to take place on Monday morning.
The application is listed as a motion in the cause list, which means it is a completely new application concerning the case.
It mentioned Ajamalul Hossain QC, Syed Ahmed and Muhammad Saifullah Mamun as its lawyers.
Supreme Court lawyer Advocate AKM Amin Uddin Manik, who is serving as Deputy Attorney General, told Dhaka Tribune that the virtual court has no example of anticipatory bail in its history, and the Supreme Court also has no practice direction on the matter for the High Court bench to follow.
The lawyer cited a similar case back on July 6, when Md Shah Alam Hossain Jibon, Kamal and Ruhul Amin filed anticipatory bail petition from the High Court's virtual bench of Justice Nazrul Islam Talukder in connection with a money laundering case in Mohammadpur police station. The bench deleted the petition from the cause list as there was no history of granting such kinds of bail with virtual hearing.
According to the law, no one can seek any remedy, including anticipatory bail, from the court while staying abroad, he added.
The brothers were accused of threatening and abusing the Exim Bank Managing Director Mohammad Haider Ali Mia and Additional Managing Director Mohammad Firoz Hossain.
National Bank Limited, a concern of Sikder Group, refuted the allegations through their lawyer Abdul Baset Majumder, stating that the case was filed to socially defame them.
The brothers took a private air ambulance of R&R Aviation, another concern of Sikder Group, and left the country on the morning of May 25. However, the news came to light much later on May 29.
