HC orders withdrawal of two policemen for confining lactating mothers

The High Court on Wednesday ordered withdrawal of two police officers, including the officer-in-charge of Madaripur police station, for separating two nursing mothers from their infants for 13 hours. The inspector general of police was asked to submit a probe report on the incident by May 8. On March 21, the High Court summoned the police over the issue in response to a public interest litigation filed by lawyer Rana Kawser. The court also issued a ruling, asking why inhumane detention should not be declared illegal and beyond jurisdiction. The home secretary, inspector general of police, Madaripur superintendent of police, and the Madaripur police station OC have been asked to respond to the ruling within four weeks. In compliance with the court’s previous order, OC Ziaul Morshed and SI Md Mahtab Hossain appeared before the HC bench of Justice Quazi Reza-Ul Hoque and Justice Mohammad Ullah and prayed for unconditional mercy. The court said:  “We will consider the sentence after the probe report is submitted.” Petitioner Rana Kawser told reporters that on March 12, SI Mahtab Hossain had gone to Lakshmiganj to investigate a case filed over the ownership of a piece of land. The SI interrogated Panir Hossain, a resident of the area, about the disputed land. The SI slapped Panir when the latter said he did not know anything. An altercation took place among the police and Panir’s family members. SI Mahtab received police backup soon after. At one stage, the police dragged Panir’s wife and sister-in-law to the vehicles and took them to the police station. The women were forced to leave their two infants behind. Around midnight, police released the women after taking their signatures on a blank paper. The lawyer said such an act on part of the law enforcers was illegal and a violation of human rights.
