HC declines to hear petition against Dhaka 8 polls result

The High Court bench said it had no jurisdiction over the matter

A High Court bench on Thursday refused to hear a writ petition filed challenging the victory of Rashed Khan Menon in Dhaka 8 constituency in the December 30 general election.

Advocate Yunus Ali Akhand, who contested the polls from Dhaka 8 on a Jatiya Party ticket, filed the petition on Tuesday.

The bench of Justice Syed Refaat Ahmed and Justice Md Iqbal Kabir declined to hear the petition, saying their bench had no jurisdiction to hear petitions related to the election.

They further said the petitioner could move his plea to any other bench.

Yunus filed the petition seeking the High Court’s directive for the Election Commission to cancel the results of the constituency, citing irregularities. 

He accused Menon of violating the 2008 Electoral Code of Conduct by using Awami League President Sheikh Hasina’s image on his campaign posters.

Menon, who is the president of Workers Party of Bangladesh, contested the polls from Awami League-led Grand Alliance and won the seat with 139,538 votes.

Yunus secured only 374 votes. 

He further claimed that Menon held “an office of profit” when he contested the polls.

He also alleged that on the election day, voters in Dhaka 8 could not vote as Menon’s agents stuffed the ballot boxes.

His petition pleaded with the High Court to order the Election Commission not to include Menon as the elected candidate in the gazette notification.
