HC: Why not grant bail to two ‘mentally ill’ inmates

The High Court has asked the authorities concerned why two men, believed to be having mental illness, and incarcerated for more than a decade, should not be freed on bail. Shofikul Islam has been in prison since April 25, 2001, and Sabid Ali since June 29, 2003, in separate murder cases. Justices Obaidul Hassan and Krishna Debnath's bench ordered the Kishoreganj prison authorities on Thursday to produce the two men before it on January 19. It also directed the government to file related case documents on the same day. The bench issued the ruling on its own volition after Supreme Court Legal Aid panel lawyer Kumar Debul Dey brought the matter to the court's notice. A private TV channel had run a report on the two men's plight last month. “Both Shofikul and Sabid have mental illness,” Kumar said, without elaborating. The court had finished recording witness testimonies in the case against Shafikul in 2006. Witness deposition in Sabid's case is going on, he added.
