The High Court issued a rule on Tuesday questioning why the administration of the oath of office to the president by the parliament speaker should not be deemed illegal.
Following a preliminary hearing on the related writ petition, a High Court bench led by Justice AKM Asaduzzaman issued the rule.
The court asked the secretary of the Law Ministry, the cabinet secretary, and other relevant authorities to respond within four weeks.
Barrister Omar Faruq represented the petitioner during the hearing.
The writ petition was filed on Monday, challenging the legality of the speaker of parliament administering the oath to the president.
Lyricist and constitutional analyst Shahidullah Farazi filed the petition.
Following the filing, Barrister Omar Faruq said: "In Bangladesh’s first constitution, the chief justice was responsible for administering the oath to the president. However, later constitutional amendments included the provision allowing the speaker to administer the president’s oath.
"The petition argues that just as the president administers the chief justice’s oath, the chief justice should also administer the president’s oath."
