Court says it cannot direct the parliament to formulate a law

The High Court has turned down a petition seeking its order over a new law to form the Election Commission after the term of the commissioners expire.
The bench of Justice Md Mozibur Rahman Miah and Justice Md Kamrul Hossain Mollah said on Sunday that the court cannot tell the parliament to formulate a law.
Lawyer Md Earul Islam, also a leader of political outfit Bangladesh Congress, filed the petition last month arguing that the Constitution stipulates the formulation of a specific law for the formation of the commission.
According to the petition, the government appoints the commissioners in an arbitrary manner which is a constitutional violation.
The petitioner told the media that they would move the Appellate Division against the order.
In line with the existing regulations, the president appoints election commissioners.
However, in 2017, the Bangabhaban formed a search committee, for the first time in the country’s history, to recommend names for election commissioners.
