Why circular on bank salaries should not be declared illegal, asks High Court

Court orders finance secretary and governor to respond within seven days

The High Court (HC) on Monday issued a ruling asking authorities concerned to explain why the Bangladesh Bank (BB) circular fixing minimum salary for bankers should not be declared illegal. 

The court has also asked the secretary of the finance ministry and the governor of BB to respond to the ruling within seven working days. 

HC bench of Justice Mamnoon Rahman and Justice Khandaker Diliruzzaman issued the ruling following a writ petition, filed by Supreme Court lawyer Farhad Bin Hossain.

The HC also appointed four amicus curiae seeking expert opinion on whether the BB can issue such circulars. The amicus curiae are—Attorney General AM Amin Uddin, barrister Ajmalul Hossain QC, Rokanuddin Mahmud and advocate Probir Niyogi.

Earlier, on 20 January, the central bank issued a directive fixing the minimum salary for bankers at Tk28,000. It also said that no one can be fired on the pretext of not achieving the target or incompetence creating much debate among senior bankers and bank owners. 

Later, another circular was issued on February 1 relaxing some of the conditions prescribed earlier.
