The High Court has ordered the handover of property belonging to late Attorney General KS Nabi to his grandsons Adian Nabi and Nahian Nabi.
As per the court order, KS Nabi’s brother and the children’s uncle Barrister Rehan Nabi must handover the property within two weeks. Prior to the handover, Rehan must pay Tk1 lakh in alimony to the children.
A High Court bench led by Justice Abu Taher Md Saifur Rahman issued the order on Sunday, when both parties appeared before the court.
Earlier on October 4, the two children were able to return home to their father’s property after the High Court issued a Suo moto order in a rare midnight session.
The children had been living with their father Kazi Siratun Nabi, a Supreme Court lawyer, since his divorce from mother Sahanaj Nabi. They moved back in with their mother for some time after his death on August 10.
When they tried to return to their father’s house, the children were denied entry by uncle Barrister Kazi Rehan Nabi, also a Supreme Court lawyer, according to Ekattor TV. The reason why he denied them entry remains unclear.
On September 3, the High Court bench of Justice Abu Taher Md Saifur Rahman issued the Suo moto order for the children to be allowed to return home after watching a video of the children explaining their predicament that was televised on an Ekattor TV program. The children were present in court.
Once court proceedings were over, Dhanmondi police returned the children to their home, in compliance with the court order. The children are staying there with their mother.
On the Ekattor TV program, Mehrin Ahmed, the children’s aunt and the person who reportedly informed Dhanmondi police of the situation, had claimed Kazi Rehan Nabi was trying to keep his nephews from returning to the house in an attempt to seize ownership of his late brother’s property.
Kazi Siratun Nabi’s house belongs to his sons through rights of inheritance, she had said.
Advocate Manzil Murshid, who also joined the televised program, said the incident is an example of human rights violation.
The anchor of the program had urged the High Court to issue a suo moto order, to enable the children to return home.
