Lakshmipur ex-civil surgeon saga: High Court warns ADC, UNO for abuse of power

Laskmipur Additional Deputy Commissioner (ADC) Shaikh Murshidul Islam and Sadar Upazila Executive Officer (UNO) Kamruzzaman have been warned for sentencing a former civil surgeon through a mobile court. The High Court has asked the government to post Lakshmipur ADC and UNO at places where they cannot abuse their authorities. The High Court bench of Justice Quazi Reza-Ul Hoque and Justice Mohammad Ullah gave the observation on Wednesday. It also discharged its previous rule accepting the unconditional apologies by the duo, over sentencing a retired civil surgeon to three-month imprisonment. "We are asking secretaries for law, public administration and home not to post them in such a place so that they can abuse their power," the court said in its observation. The court, in its order, also commented that the mobile court is being operated sitting in the office and abusing its power. Earlier in the day, Lakshmipur ADC Shaikh Murshidul Islam and UNO Kamruzzaman presented unconditional apology to the High Court over sentencing the retired civil surgeon for allegedly assaulting the ADC.

The High Court summoned the duo on December 5 to appear before the court on December 13 and explain the verdict handed to the former civil surgeon. The court came up with the order following a writ petition filed by Supreme Court lawyers Advocate Kamal Hossain Niazi and Advocate Ashfaqur Rahman. It then also issued a rule asking the authorities concerned to explain why the misuse of the mobile court out of personal grudges should not be declared illegal. Earlier on December 4, former Civil Surgeon of Lakshmipur Dr Salahuddin Sharif was sentenced to three months imprisonment by a mobile court led by UNO Kamruzzaman, for allegedly assaulting Murshidul. Dr Salahuddin and Murshidul went to pick up their grandson and son respectively from a Kakoli Shishu Angan kindergarten in the district town around 10:15am. The two then got into a scuffle at the crowded school gate. At one stage of brawl, the ADC slapped the retired civil surgeon and was reciprocated with a similar response. Later, police detained Dr Salahuddin and produced him before the mobile court which handed down the sentence. A Lakshmipur court later granted bail to the former civil surgeon on a bond of Tk 5,000. Mir Shawkat Ali, additional district magistrate (ADM), passed the order after Rasel Mahmud Manna, lawyer of Dr Salahuddin Sharif, filed the bail petition.
