The High Court has summarily rejected a writ petition challenging the validity of Article 70 of the Constitution and seeking suspension of the schedule for the presidential election.
A High Court bench comprising Justice Khizir Ahmed Choudhury and Justice AFM Saiful Karim passed the order on Tuesday.
Advocate Md Yunus Ali Akand, who filed the writ petition, appeared for the petitioner. Attorney General Md Ruhul Quddus Kazal, Deputy Attorney General Mamun Choudhury and Akhter Hossain Md Abdul Wahab represented the state.
Advocate Yunus Ali Akand filed the petition on August 13, challenging the constitutional provision and seeking suspension of the presidential election schedule.
Article 70 of the Constitution states that if a person elected to Parliament as a candidate nominated by a political party resigns from that party or votes against it in Parliament, their seat will become vacant. However, they will not be disqualified from contesting a subsequent parliamentary election for that reason.
The lawyer later said Article 70 prevents lawmakers from voting independently and undermines their democratic rights.
