Kamaruzzaman to file review petition

Update : 06 Nov 2014, 05:58 AM

Convicted war criminal Mohammad Kamaruzzaman will file a review petition against the Appellate Division's verdict, says his counsel.

The petition will be filed within 30-day from the date when the defence receives the full verdict copy.

Lawyer Shishir Monir disclosed the matter to the journalists after meeting Kamaruzzaman at the Dhaka Central Jail on Thursday morning.

A four-member lawyers team  met him at the Dhaka Central Jail.

He said: “Kamaruzzaman will file a review petition within 30-days after getting the full copy of the verdict. He will think about the clemency of President if the review petition is scrapped.”

Talking about the war crime charges, the lawyer said: “Kamaruzzaman has denied the charges brought against him.”

“In fact, he told us that he heard about the crimes in Shohagpur after the trial started in the International War Crimes Tribunal,” he said.

He said they hope they will get justice from the Supreme Court.

Talking about the law minister's statement, he said: “As per Section 105 of the Constitution, there is a scope of filing review petition against the apex court's verdict. Two hearings were conducted regarding the review petition of Quader Molla.”

“The tribunal has not even singed it, then how can any step be taken regarding Kamaruzzaman's execution,” he asked.

“The copy of the full verdict has not been given to any authority concerned. According to the system, we need the full verdict copy to file review petition,” he said regarding the attorney general's statement.

“Without this, how can we file it?” he also asked.

Law Minister Anisul Haq Wednesday ordered the jail authorities to take the necessary preparations in order to execute Kamaruzzaman.

Kamaruzzaman, the senior assistant secretary general of Jamaat-e-Islami, will get seven days to seek the presidential clemency, said the law minister in a press briefing.

On Wednesday, the family members of condemned war criminal Mohammad Kamaruzzaman met with him at the Dhaka Central Jail.

On May 9 last year, International Crimes Tribunal awarded death sentence to Kamaruzzaman for committing heinous crimes against humanity. He appealed against the judgement after a month.

On Monday, Appellate Division of the Supreme Court upheld the death penalty to Kamaruzzaman for crimes against humanity committed during the 1971 Liberation War.

On Tuesday, Kamaruzzaman was shifted to Dhaka Central Jail from Kashimpur Jail in Gazipur.
