A Supreme Court lawyer has filed a writ petition with the High Court seeking restriction on retired HC judges from practising law at the Appellate Division of the Supreme Court.
Supreme Court lawyer Eunus Ali Akond filed the writ petition on Monday morning.
In the petition, he prayed to scrap the provision of the constitution that allows retired HC judges to practice law.
The petition may be heard by the HC next week, Akond told the Dhaka Tribune.
According to the petition, the retired HC judges are permitted to practice law under Section 33 of the 15th amendment which is contradictory to the 1972 constitution.
He said it is contradictory as the 15th amendment of constitution has restored the original constitution of 1972 which does not allow them to practice law.
The retired judges actually were allowed to practice law as per an amendment in 1978 by Ziaur Rahman.
He said that two retired HC judges Justice Nozrul Islam Chowdhury and Justice Shahidul Islam are practising law in the SC despite of enjoying state facilities.
