Attorney general: Presidential election Thursday, no legal hurdle

On August 18, the High Court summarily rejected a writ petition seeking to challenge the validity of Article 70 of the Constitution

There are no legal obstacles to holding Thursday's presidential election smoothly, Attorney General Barrister Ruhul Quddus Kajal has said. 

He made the comment while responding to questions from journalists at the Attorney General’s Office on Wednesday.

On August 18, the High Court summarily rejected a writ petition seeking to challenge the validity of Article 70 of the Constitution and suspend the schedule for the presidential election. The bench comprising Justice Khizir Ahmed Choudhury and Justice AFM Saiful Karim passed the order.

Advocate Yunus Ali Akand, who filed the writ, appeared for the petitioner.

Attorney General Mohammad Ruhul Quddus Kajal, Deputy Attorneys General Mamun Chowdhury and Akhtar Hossain Mohammad Abdul Wahab represented the state.

Akand filed the writ petition on August 13.

Article 70 of the Constitution states that if a person is elected to Parliament as a candidate nominated by a political party and subsequently resigns from that party or votes against it in Parliament, their seat will become vacant. However, they will not be disqualified from contesting a subsequent parliamentary election for that reason.

The petitioner’s lawyer later said Article 70 prevents lawmakers from voting independently and undermines their democratic rights.
