The hearing for the review petition filed with a Cox’s Bazar court, challenging the legality of the trial procedures in the murder case of retired Bangladesh Army Major Sinha, has been rescheduled for the second time on Monday.
Inspector Liakat Ali, prime accused in the case, in his petition claimed that the entire trial conducted is not in line with the Section 205D of the Code of Criminal Procedure, thus the justice procedure is illegitimate.
The hearing has been rescheduled to December 13, after the lawyer of the murder case's plaintiff, Advocate Md Mostofa pleaded to the court for more time, stating issues related to health.
"There is no base for challenging the legitimacy of the justice procedure," said Md Mostofa, adding that the plea by the accused was made to confuse the court. Mostofa expressed his confidence of securing the judge's decision in his client's favour.
On October 14, Advocate Md Masud Salauddin on behalf of Liakat made a revision appeal to the court of Cox's Bazar District and Sessions Judge Md Ismail, challenging the legitimacy of the justice procedure.
After a preliminary trial, the judge scheduled October 20, for the complete trial. Afterwards the hearing date was rescheduled to November 10 (Tuesday).
Sinha Mohammad Rashed Khan, 36, who took early retirement from the Bangladesh Army in November 2018, was shot dead at a police checkpoint in the Cox’s Bazar-Teknaf Marine Drive in Shamlapur on July 31.
Sinha’s sister Sharmin Shahriar Ferdous filed a murder case with the judicial magistrate court in Cox’s Bazar on August 5 accusing nine police personnel.
