Doctor’s death: Father sues BSMMU hepatology chief, 2 others

The complainant also requested the court to issue an arrest warrant against the accused doctors

Professor Dr Mamun Al Mahtab Shwapnil, chairman of the hepatology department at Bangabandhu Sheikh Mujib Medical University (BSMMU), and two other doctors have been sued over the death of Dr Towfiq Enam.

Senior physiotherapist Akteruzzaman Mia, father of the deceased, filed the lawsuit with Dhaka Chief Metropolitan Magistrate's Court on Sunday, accusing the three doctors of negligence of duty, leading to the death of his son.

The two other accused are Prof Abdul Wahab Khan, consultant laparoscopic surgeon of Islami Bank Central Hospital in Kakrail, and Prof Dr Mohammad Ali, hepatobiliary surgeon of BRB Hospital in Kalabagan.

The complainant also requested the court to issue an arrest warrant against the accused doctors.

After recording Akteruzzaman Mia’s statement, Dhaka Metropolitan Magistrate Rajesh Chowdhury directed the Criminal Investigation Department (CID) to investigate the allegation with an assistant superintendent of Police (ASP) ranked official and submit a report by July 19.

According to the case details, on May 4, Dr Towfiq Enam was admitted to Islami Bank Hospital and Dr Abdul Wahab Khan diagnosed him with gallbladder stones and discharged him after surgery on May 5.

After the surgery, Dr Towfiq Enam became seriously ill and met with Dr Wahab Khan on May 9, who then referred him to Dr Mahtab at the Labaid Hospital.

Dr Mahtab carried out a endoscopic retrograde Cholangiopancreatography or ERCP with stenting after assuming that a clip was put at the wrong place during the surgery.

As the patient’s condition quickly deteriorated further, he was sent to Dr Mohammad Ali at BRB Hospital. Dr Mohammad Ali admitted Dr Towfiq Enam to the hospital on May 12 for an urgent operation.

The relatives of the patient requested the doctor to give him proper treatment but they did not do so,  the case statement said. Dr Enam died there on May 30.

The complainant filed the case on June 15 with Kalabagan police station against the three accused, but police suggested him to file the case with the court, the case statement added.
