HC halts joining of Viqarunnisa’s new principal

The petitioner applied for a rule, in the interim the petitioner asked the court to stay the appointment order while the rule hearing is in progress

The High Court has stayed the joining of the newly-appointed principal of Viqarunnisa Noon School and College, Fauzia Rezwan. 

The High Court bench of Justice M Enayetur Rahim and Justice MD Khairul Alam passed the order while hearing a supplementary petition in this regard on Monday. 

The court also said it will pronounce further orders over the issue on Tuesday, and asked the state to ensure that the principal does not join her new position before 11am of the day.

Advocate Eunus Ali Akond stood for his petition while Deputy Attorney General Amit Das Gupta represented the state. 

Advocate Eunus Ali Akond said, according to the Teachers’ Service Regulation 1979, only the governing body of Viqarunnisa Noon School and College has the authority to appoint a principal. However, the government ignored the rules, and appointed a principal, who is an official of the Directorate of Secondary and Higher Education (DSHE). The appointment procedure was contradictory to the law. 

The petitioner applied for a rule, in the interim the petitioner asked the court to stay the appointment order while the rule hearing is in progress.

Eleven persons were made respondents, including the secretary to the Ministry of Education, chairman of Dhaka Education Board, principal of the Viqarunnisa Noon School and College, and the District Commissioner of Dhaka. 

On December 2018, Viqarunnisa Noon School and College fell into turmoil after acting principal Nazneen Ferdous, along with two other teachers, were removed on allegations of instigating a student towards commiting suicide.
