A writ petition has been filed with the High Court seeking directives for the authorities concerned not to administer oath to Workers Party of Bangladesh President Rashed Khan Menon, who won Sunday's election from the Dhaka 8 constituency.
Supreme Court lawyer Eunus Ali Akond, who was a Jatiya Party candidate in the polls from the same parliamentary seat, filed the writ petition on Tuesday.
The writ also sought a court ruling asking the government to explain as to why the announcement of the results, declaring Menon victorious in Dhaka 8, should not be declared illegal.
At the same time, it sought directives to postpone the publication of the gazette and oath-taking ceremony for the Workers Party president.
Seven individuals - the chief election commissioner, speaker of parliament, law secretary, Dhaka returning officer, the workers party president, and the secretary of the President's Office – were made respondents to the ruling.
In the writ, Eunus Ali alleged that Menon’s supporters stuffed ballot boxes, depriving genuine voters of casting their votes.
“I lodged a complaint with the Election Commission, but they did not pay any heed to it, which violated Section 66 of the constitution,” he further said.
Besides, Menon contested the polls holding a profitable post, which is also a violation of Section 20 of the Representation of the People Order (RPO), he added.
The bench of Justices Syed Refaat Ahmed and Md Iqbal Kabir is likely to hear the petition on Wednesday.
Menon, a Grand Alliance candidate, was unofficially elected from the Dhaka 8 constituency in the 11th general polls on Sunday, securing 139,538 votes. His nearest rival Mirza Abbas of BNP got 38,717 votes.
