A Dhaka court has transferred the case filed against cricketer Rubel Hossain to the Woman and Children Repression Prevention Tribunal.
Dhaka Metropolitan Magistrate Ashok Kumar Dutta passed the order of transferring the case after accepting the charge sheet on Monday morning.
Rubel’s lawyer Barrister Moniruzzman said: “The case has been transferred as the Dhaka court does not have the jurisdiction to exempt Rubel from the case.”
On April 6, police submitted the final report seeking Rubel Hossain's exemption from the charge of the case filed under the Prevention of Oppression Against Women and Children Act.
The official mentioned they had found no evidence of rape during an investigation in the case. So, Rubel could be acquitted.
Actress Happy filed the case against Rubel with Mirpur police under the Women and Children Repression Prevention Act on December 13.
According to Section 9(1) of The Prevention of Oppression Against Women and Children Act 2000, whoever has sexual intercourse without lawful marriage with a woman by fraud shall be said to commit rape.
It states anyone commits the offence shall be punished with rigorous imprisonment for life and with fine.
On December 31, a Dhaka court gave the permission to conduct the DNA test of Rubel Hossain in the case.
Previously, police collected some samples from Rubel’s residence and sent them to the laboratory of the Criminal Investigation Department for the tests.
According to the FIR, Rubel told Happy that they would marry and had an affair that included physical relations for the last nine months. The couple was together as recently as December 1.
Happy, the heroine of “Kichhu Asha Kichhu Bhalobasa,” said they first met through friends and then stayed in touch via Facebook and mobile telephone.
24 year-old Rubel made his debut in international cricket in 2009 and has so far appeared in 22 Tests, 53 ODIs and 11 Twenty20 internationals.
