Jammat-e-Islami leader Abdul Quader Molla was found guilty for his involvement with crimes against humanity during the 1971 liberation war.
On February 5, the International Crimes Tribunal awarded him life imprisonment for his offences.
Later, the Appellate Division of the Supreme Court pronounced its verdict of sentencing death to war criminal Quader Mollah on September 17 and released its full judgement on December 5.
The charges and verdicts against Molla
On February 5 during pronouncing verdict Tribunal told that, Quader Molla is found guilty of the offences of ‘crimes against humanity’ enumerated in section 3(2) of the International Crimes (Tribunals) Act, 1973 as listed in charge no 1, 2, 3, 5 and 6 and he be convicted and condemned to a single sentence of ‘imprisonment for life’ for charge no. 5 and 6 And also for the crimes as listed in charge nos. 1, 2 and 3 to a single sentence of ‘imprisonment for fifteen (15) years’ under section 20(2) of the Act of 1973.
The accused Abdul Quader Molla is however found not guilty of offence of crimes against humanity as listed in charge no.4 and he be acquitted thereof.
Then state appealed because Five out of six charges brought against Quader Molla were proved beyond reasonable doubt but the International Crimes Tribunal-2 sentenced him to life imprisonment in two charges and different term’s jail in the other three proved charges.
Earlier on May 28 of 2012 tribunal framed six charges against Jamaat-e-Islami leader Abdul Quader Molla for involvement in murders and mass killings during the Liberation War in 1971.
According to the charges, Molla ‘actively participated’ in the killing of at least 381 unarmed people in Dhaka’s Mirpur and Keraniganj areas in six different incidents. He also aided the Pakistan army to kill and rape civilians.
Quader Molla, now assistant secretary general of Jamaat, was born in Amirabad village under Sadarpur of Faridpur in 1948. He was arrested on charges of killing 345 people during the war on July 13, 2010. Later, he was shown arrested in a case for crimes against humanity committed in 1971.
The prosecution on December 18 last year submitted formal charges against him before Tribunal-1, which took the charges into cognisance on December 28 of 2011. On April 16 of 2012 the case was transferred to Tribunal-2, where both the prosecution and the defence placed their submission on May 2, 8, 9, 14 and 16.
Charges framed by ICT 2
Charge 1: On Quader Molla’s instruction, one of his aides named Akhter killed Pallab, a student of Bangla College and an organiser of the Liberation War, on April 5, 1971. Pallab was buried by the side of Kalapani Jheel along with several other bodies. Pallab was taken to an Eidgah at Mirpur-12, where he was shot to death.
Charge 2: On March 27, 1971, Quader Molla and his aides murdered pro-liberation poet Meherun Nesa, her mother and two brothers at their house at Mirpur-6.
Charge 3: On March 29, 1971, Abdul Quader Molla along with other members of Al Badr, Razakar and non-Bangalees detained Khandakar Abu Taleb from Mirpur 10 bus stand and tied him up with a rope. He was brought to the Mirpur Jallad Khana Pump House and killed.
Charge 4: On November 25, 1971, Quader Molla with his 70 accomplices went to the village of Khanbari and Ghotan Char, now Shaheed Nagar of Keraniganj, and abducted two unarmed freedom fighters from the house of Mozaffar Ahmed Khan. Freedom fighters Osman Gani and Golam Mostafa were brutally murdered by charging bayonet.
Charge 5: Attack and indiscriminate shooting by Quader Molla and his gang killed hundreds of unarmed people of the two villages. Among them, 24 persons were named in the charge.
On the early morning of April 24, members of Pakistan occupation forces and around 50 non-Bangalees in presence of Quader Molla raided Alubdi village of Mirpur and attacked on unarmed villagers, killing 344 people.
Charge 6: On March 26 of 1971 at evening by led of Quader Molla, some Bihari and Pakistani soldiers killed Hazrat Ali and five members of his family at Mirpur. Entering His house Quader Molla shot dead Hazrat and killed wife Amina and daughters Khadija and Tahmina. That day they killed his only two years old son Babu by dashing the baby against the ground.
