The Supreme Court has directed divisional special judges’ courts and special judges’ courts to dispose of the graft cases in 60 days after taking cognizance of their charges.
A notification signed by the SC registrar, Abu Syed Diljar Hussain, on behalf of the chief justice, was issued to this effect on Wednesday.
The notification reads that divisional special judges’ courts and special judges’ courts will settle the trial proceedings of the corruption cases in 60 days after taking cognizance of their charges.
It reminded that there is specific provision in the Criminal Law Amendment Act, 1958, to finish the graft cases in 60 days.
The notification also said the government has formed divisional special judges’ courts and special judges’ courts to quickly settle the cases filed under the Anti-Corruption Commission law.
But the apex court noticed that the district judges, sessions judges and metropolitan sessions judges are not sending the corruption cases to the divisional special judges’ courts to finish their trials.
Rather, the courts are keeping these cases to their possessions or sending the cases to additional sessions judges or joint session judges.
And for this, these divisional special judges’ courts are not getting enough graft cases to finish.
Moreover, the SC noticed that the divisional special judges’ courts or special judges’ courts are not disposing of these corruption cases within the stipulated time and the number of the settled cases are not satisfactory level.
Under the circumstances, the SC authorities directed all district judges, sessions judges and metropolitan sessions judges to dispose the corruption cases in the quickest time and to send such cases to divisional special judges’ courts or special judges’ courts in the stipulated time.
Also, the apex court ordered the divisional special judges’ courts or special judges’ courts to give priority for disposal of the graft cases within the fixed time.
