SC stays HC verdict on shifting Samajik Shikkhakendra school

The Supreme Court yesterday stayed a High Court verdict that had declared illegal two ministerial letters against the shifting of Samajik Shikshakendra Government Primary School located on Bailey Road in the capital.

The four-member Appellate Division bench, led by Justice Surendra Kumar Sinha, passed the order after hearing a leave-to-appeal petition, filed by Girls Guides Association, against the verdict.

Additional Attorney General Murad Reja told the Dhaka Tribune that this order allowed Girls Guides Association to continue its activity in its present location unless appeals were settled.

Samajik Shikkhakendra Government Primary School is located on a piece of land, which has been taken lease by Girls Guides Association from the government.

As Girls Guides Association felt the need for using this land for their own purpose, they moved to shift this school elsewhere, promoting the government to issue two letters against it on May 18, 2008.

According to the letters, the school is a government infrastructure and its land and building is also a government property and so there is no scope to shift it.

Girls Guides Association then filed a writ petition challenging the legality of the letters issued by the ministry about the shifting of this school.

Additional Attorney Murad Reza represented the government while Aadvocate Munsurul Haque move for the girls guide side.
