The High Court has rejected two separate writs seeking its directive for regularising ABM Altaf Hossain as a HC judge.
An HC bench comprising of Justice Hasan Arif and Justice Mohammad Ullah passed the order on Wednesday afternoon.
ABM Altaf Hossain’s lawyer Salauddin Dolon confirmed about the matter to the Dhaka Tribune.
Earlier, ABM Altaf Hossain and SC lawyer Idrisur Rahman filed two separate writs in this connection.
On August 14, one of the judges of a two-member High Court bench has felt embarrassed to hear the writ petition filed by Altaf Hossain.
ABM Altaf Hossain filed the petition on August 12.
On July 7, a legal notice was served for regularising ABM Altaf Hossain as a High Court judge as Chief Justice Md Muzammel Hossain recommended him.
Idrisur Rahman, a Supreme Court lawyer, sent the notice to the Secretary of President Office, Principal Secretary of Prime Minister’s Office, Secretary of Law Ministry and Supreme Court Registrar demanding the former additional judge to appoint him as a regular judge within 72 hours.
It is said in the legal notice that the executive had flouted the constitution as well as a Supreme Court judgement by not regularising Altaf because Chief Justice recommended him.
In reply to a question of the Dhaka Tribune, Idrisur Rahman said: “Media reported that the Chief Justice also made recommendation for Altaf alongside five other additional judges. But the executive dropped Altaf and none denied about the matter.
So, it is contrary to the constitution, independence of judiciary and rule of law."
If Altaf is not regularised within 72 hours, a writ petition would be lodged with the High Court, Idrisur said.
Later, he filed another writ with the HC.
