High Court verdict stayed: Comilla-2 polls to be held under EC boundaries

The Appellate Division has stayed a High Court verdict that declared illegal the Election Commission’s gazette redefining the boundaries of the Comilla-2 constituency, clearing the way for elections to be held under the EC’s revised delimitation.

As a result, the Comilla-2 constituency will comprise Homna and Titas upazilas, as determined by the Election Commission.

The order was passed on Tuesday by an Appellate Division bench led by Chief Justice Zubair Rahman Chowdhury after granting leave to appeal against the High Court ruling.

The legal challenge was initiated by Nazim Uddin Alam, a Jamaat-nominated candidate, who filed a writ petition questioning the legality of the EC’s decision to alter the constituency boundaries.

Following the hearing, the High Court issued a rule on September 24, 2025, asking why the boundary changes for the 13th National Parliament election should not be declared illegal. The bench, comprising Justice Md Mujibur Rahman Mia and Justice Bishwajit Debnath, later delivered its verdict on January 8, declaring the EC’s gazette unlawful.

The High Court also directed the Election Commission to republish a gazette within 24 hours, restoring the previous boundaries of the Comilla-2 constituency, thereby upholding the rule.

Senior lawyers Barrister Ehsan Abdullah Siddique and Barrister Saiful Islam Ujjal represented the petitioner during the High Court proceedings.

During the hearing, the lawyers argued that Meghna and Titas upazilas had previously constituted Comilla-2, but under the revised delimitation, Homna was added while Meghna was shifted to Comilla-1.

Following the High Court verdict, an appeal was filed with the Appellate Division, which has now stayed the ruling, reinstating the EC-determined boundaries for the upcoming election.
