Eleven MPs have filed a writ petition with the High Court challenging the legality of the decision to assign district-based responsibilities to ministers, state ministers and whips.
The Cabinet secretary has been named as the respondent in the petition.
The petitioners’ lawyer, Mohammad Shishir Monir, confirmed the filing on Sunday.
Shishir Monir said similar district-based responsibilities were assigned to ministers, state ministers and whips in 2001. A writ petition was filed challenging that decision, and the High Court Division later declared the arrangement unconstitutional.
“Under the Rules of Business, the Constitution and the High Court’s previous judgment, such a decision is beyond legal authority and therefore unlawful,” he said.
The petitioners said the court should determine whether the decision to assign responsibilities on a district-by-district basis has any legal basis and whether it is consistent with the Constitution and existing laws.
