HC asks why DU teacher's forced leave should not be illegal

The High Court on Monday issued a rule asking officials concerned to explain why the decision to send Dhaka University's economics department Assistant Professor Dr Rushad Faridi to forced leave should not be declared illegal. A High Court bench passed the order after holding a primary hearing on a writ petition filed by Barrister Jyotirmoy Barua, reports Bangla Tribune. The court ordered six officials, including the Dhaka University vice chancellor and the registrar to reply to the rule by two weeks. After the hearing, Barrister Jyotirmoy Barua said a syndicate meeting of Dhaka University took the decision to send Dr Rushad Faridi on compulsory leave on July 12 without issuing any show cause. “There is no provision in the University Act that allows the syndicate to send any staff member on compulsory leave. The DU teacher sent a legal notice to five people including Vice Chancellor AAMS Arefin Siddique demanding reconsideration of the decision. The notice asked for reply within 48 hours. As they did not respond, a writ petition was filed in High Court on July 20 and the HC today issued the rule after hearing the writ,” said Jyotirmoy, the lawyer of Rushad. A syndicate meeting, chaired by VC Arefin Siddique, took the decision to send the teacher on compulsory leave on July 13. Syndicate member Professor Farid Ahmed earlier told the Dhaka Tribune: “Thirty-one teachers have raised allegations against Dr Rushad and said they will not work with him. “A committee has been formed to look into the allegations, and the teacher has been sent on compulsory leave while the investigation takes place,” he added.
