The Appellate Division has stayed a High Court order that suspended the decision to set up a cattle market in Aftabnagar, Dhaka, ahead of the upcoming Eid-ul-Azha.
As a result, there is no obstacle to setting up a cattle market in Aftabnagar, lawyers said on Wednesday.
The Appellate Division headed by Justice Obaidul Hassan made the ruling after hearing an appeal against the order of the High Court.
Senior Advocate Sayed Ahmed Raza represented the city corporation concerned in court, while Advocate Yunus Ali Akhand was in favour of the writ.
Advocate Yunus Ali Akhand filed the writ on May 15 in the public interest, seeking a directive not to set up a makeshift cattle market in Aftabnagar, while demanding environmental protection.
In the writ, the secretary of the Ministry of Local Government, Rural Development and Co-operatives, Dhaka North City Corporation, chief land officer of Dhaka North City Corporation, chairman of Rajdhani Unnayan Kartripakkha (Rajuk), Eastern Housing and Dhaka deputy commissioners were made defendants.
Subsequently, the High Court bench of Justice KM Kamrul Quader and Justice Mohammad Shawkat Ali Chowdhury halted the decision to set up a cattle market in Aftabnagar for a week and issued a rule on the termination of the lease on May 22.
In continuation of this, the High Court extended the stay order for another two months in view of the petitioner's application. Later, an application was filed in the Appellate Division against the order.
On May 2, a tender was floated through a lease notice signed by the chief property officer of the Dhaka North City Corporation on behalf of the Ministry of Local Government.
In the notice, market leases were called for the sale of sacrificial cows in seven places of the DNCC, including vacant spaces from Block B to H of Eastern Housing Aftab City, and part of Badda union council.
