Appellate Division: No bar to Ducsu election on September 9

The Supreme Court Appellate Division has upheld the Chamber Judge’s Court order, clearing the way for the Ducsu election to be held on September 9, according to legal experts.

In its order, the Appellate Division said that it was upholding the Chamber Court’s order and maintaining the suspension until October 30.

The full seven-member Appellate Bench, led by Chief Justice Dr Syed Refaat Ahmed, issued the order on Wednesday.

Earlier, on Monday, the High Court had suspended the Ducsu election until October 30.

The order was issued by a High Court Bench comprising Justice Habibul Gani and Justice Sheikh Tahsin Ali during the hearing of a writ petition filed by BM Fahmida Alam, a candidate for the post of Secretary for Liberation War and Democratic Movement Affairs.

In another order, the High Court directed that all complaints brought by the petitioner, BM Fahmida Alam, against SM Farhad, the GS candidate supported by the United Student Alliance, be submitted to the Ducsu Election Tribunal within 15 days.

The Tribunal was also instructed to consider the complaints, conduct hearings and investigations in the presence of all parties, and submit a report by October 21.

A rule was also issued in this regard.

Shortly thereafter, in response to miscellaneous appeals against the High Court order, the Chamber Judge’s Court stayed the High Court’s suspension of the Ducsu election until October 30.

The order was issued by the Chamber Judge’s Court, led by Justice Farah Mahbub, following a hearing of a handwritten petition submitted by the university authorities against the High Court’s decision.

Pursuant to this order, when the university authorities applied to the Chamber Judge’s Court on Tuesday, the matter was scheduled for hearing before the full Bench of the Appellate Division on Wednesday.

The Chamber Judge’s Court, under Justice Farah Mahbub, issued the relevant order.

According to the election schedule, the Ducsu elections are slated for September 9, with 471 candidates contesting across central and hall-level positions.

The final list of candidates shows 45 vying for vice president (VP), 19 for general secretary (GS) and 25 for assistant general secretary (AGS).
