High Court declares ‘Joy Bangla’ as the national slogan

Joy Bangla should be pronounced on national days, at state-level programs and at assemblies in educational institutions

The High Court has declared “Joy Bangla” as the national slogan, to be pronounced while celebrating national days, state-level programs and assemblies at educational institutions.

The bench of Justice FRM Nazmul Ahasan and Justice KM Kamrul Kader issued the verdict on Tuesday, after concluding the hearing of a ruling issued by another bench of the court on December 4, 2017, asking why “Joy Bangla” should not be declared a national slogan. 

The ruling followed a writ petition by Advocate Basir Ahmed, who demanded that “Joy Bangla” be made the national slogan.

Attorney General Mahbubey Alam and Deputy Attorney General ABM Abdullah Al Mahmud Bashar represented the state on Tuesday.

Senior Supreme Court lawyer Muhammad Yusuf Hossain Humayun, former law minister Barrister Shafique Ahmed, former law minister Abdul Matin Khasru and Supreme Court Bar Association President AM Aminuddin also gave their expert opinion during the hearing.

The court asked the respondents to the writ – the secretaries of the Ministry of Law, Ministry of Education, and Cabinet Division – to take necessary actions to implement its directive, which says every individual, at every level of the state, has to pronounce the slogan before and after a speech at every national program.

The respondents will also ensure that the national slogan is pronounced by teachers and students at the daily assembly in all educational institutions, the verdict said.

The court also asked for a progress report to be submitted to the registrar general of the Supreme Court within three months after implementing the order.

The court said Joy Bangla is a slogan of national unity; it was included in the historic March 7 Speech of Father of the Nation Bangabandhu Sheikh Mujibur Rahman.

The petitioner also demanded that Joy Bangla be included in the constitution as the national slogan, as a continuation of Articles 3 and 4. 

However, it is out of the court's jurisdiction as only parliament has the jurisdiction to make amendments to the constitution, the court observed.

If the government wants, it may be able to amend the constitution to legally make “Joy Bangla” the national slogan, the court added.
