Minister Maya's jail sentence upheld

The Appellate Division of the Supreme Court has rejected the petition filed by Disaster Management Minister Mofazzal Hossain Chowdhury Maya seeking review of an order of the court that scrapped his acquittal in a corruption case. A bench led by Chief Justice SK Sinha passed the order yesterday. Following the order, the High Court will hold a fresh hearing in the case to decide on the sentence. The Anti-Corruption Commission filed the case on June 13, 2007 against Maya on charge of amassing illegal wealth worth Tk29 lakh and concealing the information. A special court sentenced him to 13 years’ imprisonment in the case on February 14, 2008. Maya challenged the verdict with the High Court on May 25, 2009. After hearing the appeal, a High Court bench acquitted the minister of the corruption charges and cancelled his conviction. Later, the ACC filed a leave-to-appeal petition with the apex court. On June 14, last year, the Appellate Division cancelled the High Court verdict, saying that the High Court had not applied its judicial mind in acquitting Maya of the corruption charges. It also asked the High Court to hold further hearing and dispose of the appeal filed challenging the lower court judgement. Lawyer Baset Majumder who represented Maya at the court yesterday told reporters that they had informed the court that they would not continue the legal battle on the review petition. So, the court rejected the petition as “not pressed.” ACC lawyer Khurshid Alam Khan said that the rejection of the review petition means that Maya’s appeal against the lower court’s verdict would be reheard by the High Court.
