A legal notice has been sent to cancel the results of the 43rd BCS non-cadre candidates until the final results of the 44th BCS are announced.
The notice further urges to suspend the merit list and stop the recommendation of the 43rd BCS non-cadres to the vacant posts.
The notice was sent to three officials, including the chairman of the Bangladesh Public Service Commission (PSC).
Supreme Court lawyer Barrister Mohammad Humayun Kabir Pallab sent the notice on behalf of Maruf Hossain, Md Hasan Sardar and 500 others who took part in the oral examination of the 43rd BCS.
The letter said that the notice of the 43rd BCS examination was published on November 30, 2020. After the preliminary examination, a total of 9,841 candidates passed the written examination.
The PSC called for online preference for candidates who wish to work in non-cadre posts on December 14, 2023.
Later, on December 26, 2023, some 2,163 people were recommended for various cadre service posts and 642 people were recommended for various non-cadre posts.
However, the non-cadre merit list has not been published.
The notice further states that the 43rd BCS circular said that non-cadre candidates who have passed the relevant BCS examination but are deprived due to shortage of posts will be recommended as per the (Non-Cadre) Appointment (Special) Rules, 2010 (amended in 2014),
According to that, the PSC will preserve the posts from different ministries and recommend the non-cadre candidates of the concerned BCS step by step until the final results of the next BCS are announced.
However, the PSC has recommended 642 people for various non-cadre posts without publishing the merit list of non-cadres, which is unfair in the eyes of the law. Therefore, it must be cancelled, the letter said.
