The High Court has sought to know whether RAB has jurisdiction to arrest in Digital Security Act cases.
The High Court bench comprising of Justice Farah Mahbub and Justice Ahmed Sohail gave the order after hearing the writ seeking direction to investigate the death of a woman in RAB custody in Naogaon.
Besides, the court also wanted to know whether Sultana Jasmine was interrogated in a respectable place (police station or office) after being detained by RAB in Naogaon and whether RAB's behaviour was legal until she was taken to the hospital.
The HC has also asked to be informed about the cause of death of Sultana Jasmine in the final autopsy report.
By April 5, the state party has been asked to submit information on these issues and related laws, documents and the final report of Sultana Jasmine's autopsy. At the same time, the court has fixed the date of the next hearing of the case.
Earlier, the state filed the report of Sultana Jasmine from Naogaon General Hospital in the High Court. It was mentioned that the victim, Sultana Jasmine, was suffering from high blood pressure. She died due to excessive bleeding in the brain and was not tortured.
Lawyer Manoj Kumar Bhowmik filed a writ seeking directions to form a high-level inquiry committee headed by a retired High Court judge in connection with Sultana Jasmine's death in RAB custody. In the writ filed in public interest, the secretary of the Ministry of Home Affairs, the director general of RAB, and related parties have been made defendants.
The victim, Sultana Jasmine, 45, died three days after she had been detained by the Rapid Action Battalion (RAB) from Naogaon town on Wednesday. She died while undergoing treatment at Rajshahi Medical College Hospital on Friday morning.
Sultana Jasmine was an office assistant at the land office of Chandipur union of Naogaon Sadar upazila.
RAB claimed that they detained her for interrogation on charges of fraud, and that they had found evidence of abnormal transactions in her bank account.
Later, she fell sick and died. Quoting doctors, RAB said she had a stroke.
