No evidence of rape against Rubel

Police have submitted final report in a rape case filed by actress Naznin Akter Happy say seeking acquittal of national cricketer Rubel Hossain.

Tejgaon Victim Support Centre Inspector Halima Khatun, also investigation officer of the case, submitted the report to the Dhaka Chief Metropolitan Magistrate Court.

The official mentioned that they had found no evidence of rape during investigation in the case. So Rubel could be acquitted.

Rubel’s counsel Moniruzzaman Asad said the cricketer would appear before the court during the next hearing on April 13 and seek exemption.

Happy filed the case under Women and Children Repression Prevention Act 2000 with Mirpur police on December 13 last year.

According to section 9 (1) of the Act, whoever has sexual intercourse without lawful marriage with a woman by fraud, shall be said to commit rape. It states anyone commits the offence shall be punished with rigorous imprisonment for life and with fine.

The case says Rubel told Happy that they would marry and had an affair that included physical relations for nine months. The couple was together as recently as December 1.

Happy, the heroine of “Kichhu Asha Kichhu Bhalobasa,” said: “We had an affair and he used me.”

After filing of the case, police collected some samples from Rubel’s residence and sent those to the Criminal Investigation Department laboratory.

Earlier, the Forensic Department of Dhaka Medical College said Happy had not been raped in the recent time.
