HC receives documents of 10-truck arms haul verdict

The High Court yesterday received the documents related to 10-truck arms haul case verdict from a Chittagong court, ordering convicts including Jamaat-e-Islami chief Motiur Rahman Nizami and former state minister for home Lutfozzaman Babar be hanged.

Supreme Court Registrar AKM Shamsul Islam told the Dhaka Tribune that the HC received the documents which were sent by the Chittagong Metropolitan Special Tribunal on Wednesday.

On January 30, the special tribunal gave death penalty to 14 convicts under the Special Powers Act 1974 in a smuggling case. It also handed down life imprisonment to them under the Arms Act 1878 for the 10-truck arms haul.

According to the Special Powers Act, 1974, if a special tribunal passes death sentence, the proceedings shall be submitted immediately to the High Court division and the sentence shall not be executed unless it is confirmed by the HC.

The law also stipulates that appeal may be filed with the HC against the tribunal verdict by 30 days from the date of delivery or passing of the judgment.

As the tribunal heard both cases simultaneously, documents of the cases were sent to the HC, Mohammad Ahsan, a defence lawyer, told the Dhaka Tribune. 

He added that the High Court would give ruling after completion of hearing on both death reference and appeals in the cases, he said.
