A legal notice has been served for regularising ABM Altaf Hossain as a High Court judge since Chief Justice Md Muzammel Hossain had recommended him.
Idrisur Rahman, a Supreme Court lawyer, sent the notice yesterday to the President’s Office secretary, the principal secretary of the Prime Minister’s Office, the Law Ministry secretary and the Supreme Court registrar, demanding the former additional judge be appointed as a regular judge within 72 hours.
It is stated in the legal notice that the executive concerned had flouted the constitution as well as a Supreme Court judgement by not regularising Altaf, even after the chief justice had recommended him.
Responding to a query, Idrisur told the Dhaka Tribune: “Media reported that the chief justice recommended Altaf as well as five other additional judges. But the executive concerned dropped Altaf when no one denied the media reports.
“So, it is contrary to the constitution, the independence of judiciary and the rule of law,” he claimed.
If Altaf was not regularised by 72 hours, a writ petition would be lodged with the High Court, Idrisur said.
