A Legal notice has been served for regularising ABM Altaf Hossain as a High Court judge as Chief Justice Md Muzammel Hossain recommended him.
Idrisur Rahman, a Supreme Court lawyer, on Sunday morning sent the notice to Secretary of President Office, Principal Secretary of Prime Minister’s Office, Secretary of Law Ministry and Supreme Court Registrar demanding the former additional judge to appoint him as a regular judge within 72 hours.
It is said in the legal notice that the executive had flouted the constitution as well as a Supreme Court judgement by not regularising Altaf because Chief Justice recommended him.
In reply to a question of Dhaka Tribune, Idrisur Rahman said: “Media reported that the Chief Justice also made recommendation for Altaf alongside five other additional judges. But the executive dropped Altaf and none denied about the matter.
So, it is contrary to the constitution, independence of judiciary and rule of law."
If Altaf is not regularised within 72 hours, a writ petition would be lodged with the High Court, Idrisur said.
