Writ petition demands chief justice, not speaker, swear in president

Lyricist and constitutional analyst Shahidullah Farazi filed the writ on Monday

A writ has been filed challenging the legality of the speaker of parliament administering the oath to the president, seeking a directive that the chief justice administers the oath to the head of state.

Lyricist and constitutional analyst Shahidullah Farazi filed the writ in the High Court on Monday.

The lawyer representing the writ is Barrister Omar Faruq.

The writ names the secretary of the Law Ministry, the cabinet secretary, and other relevant parties as respondents.

Barrister Omar Faruq said: "The first constitution of Bangladesh included a provision for the chief justice to administer the oath to the president. Later, the constitution was amended to include a provision for the speaker to administer the oath to the president.

“In this writ, we have requested that the chief justice should administer the oath to the president."

The hearing of the writ petition is likely to take place before a High Court bench led by Justice AKM Asaduzzaman.
