A writ petition has been filed in the High Court challenging the validity of the “Father of the Nation Bangabandhu Sheikh Mujibur Rahman's Family Members Security Act of 2009” and the “Special Security Force Bill, 2021”.
The writ was submitted to the High Court bench comprising Justice AKM Asaduzzaman and Justice Muhammad Mahbub Ul Islam on Sunday by Supreme Court lawyer and Assistant Secretary General of the Human Rights Support Society (HRS) Mohammad Moniruzzaman in the public interest.
The petition challenges the constitutionality of Sections 2(b), 2(c), 8(1), 8(3), 8(4), and 9(2) of the Father of the Nation Bangabandhu Sheikh Mujibur Rahman's Family Members Security Act of 2009, and the Special Security Forces Bill, 2021.
The writ argues that these provisions, which extend special benefits and security to the family members of Bangabandhu Sheikh Mujibur Rahman, should be declared unconstitutional and invalid.
The law secretary, home secretary, finance secretary, Special Security Forces director general, and several members of Sheikh Mujibur Rahman's family, including former prime minister Sheikh Hasina, Sheikh Rehana, Sajib Wazed Joy, Saima Wazed Putul, Radwan Mujib Siddiq Bobby, Tulip Siddiq, and Azmina Siddiq Rupanti, have been made respondents in the writ.
The petition also requests that the court order the recovery of properties and benefits granted to the family members under the said laws.
Additionally, it seeks a directive for the law secretary, home secretary, finance secretary, and Special Security Forces DG to halt the provision of special security for the family members and to submit a report within 30 days detailing the state expenses incurred for their benefits.
