Barrister M Atiqur Rahman filed the petition on behalf of Pir Hasan Chishti. He told reporters that the bench comprising Justice Mamnoon Rahman and Justice Khandaker Diliruzzaman might hold a hearing on the writ.
After the death of Pir Iyahia Hasan on December 24, his followers pleaded with the Dhaka additional deputy commissioner seeking permission to bury the body on the premises of Shegunbagicha Panjeria Darbar Sharif.
Later, the Dhaka additional deputy commissioner gave the approval.
Meanwhile, Pir Hasan Chishti, who is the nephew of Pir Iyahia, opposed the decision claiming that the burial would breach the lease contract of the place which says the place can only be used for the purpose of worshipping.
