The High Court has issued a show-cause notice to a lawyer for allegedly helping five people, accused in a murder case, to secure bail by submitting forged documents.
The court on Wednesday cancelled the bail order and also ordered all accused to surrender within a week, if they are already released from jail.
It also asked the superintendent of police of Khulna to arrest them if do not surrender within the given time.
The bench of Justice Jahangir Hossain Selim passed the orders, after state lawyers revealed the forgery and brought the matter to the court.
Deputy Attorney General Md Bashir Ullah represented the state during the virtual hearing.
He said Advocate Abu Hena Mostafa Kamal secured bail for his clients with false First Information Report (FIR) and without annexing the charge sheet with the bail petition. In December 2019, police had submitted the charge sheet against the accused. Also the application did not mention the confessional statements given by the accused.
According to Bashir, Tipu Sheikh of Porbila under Khulna’s Digholia upazila was killed in an attack in September 2019. Later, his son Alamgir Sheikh filed a murder case accusing and naming 32 people.
Last month, Kamal filed the bail petition on behalf of five of the 32 accused — Sohag Sheikh, Selim Sheikh, Jewel Sheikh, Lutfar Sheikh and Abdullah Mollah — with a virtual High Court bench.
A bench on May 18 granted them bail based on the alleged forged documents till resumption of regular court activities.
