HC issues ruling on Sec 39 (1) of Sarkari Chakori Ain-2018

The High Court issued a rule on Sudnay, asking why without serving a show-cause notice, section 39 (1) of the Sorkari Chakori Ain-2018 should not be declared illegal, unconstitutional and void? 

Following the High Court order, among other respondents, Secretary of the Law Ministry, Chairman of the National Board of Revenue (NBR), were also asked to answer the rule within four weeks. 

Section 39 stipulates the government has the authority to sack any of its employees, convicted of a criminal offence, the notice said; this has violated another law. 

The High Court bench of Justice M Enayetur Rahim and Justice Md Mustafizur Rahman issued the rule after hearing a writ on this regard. 

Advocate Kurshid Alam Khan and Barrister Razu Miah stood for the writ while Deputy Attorney General Amit Talukder represented the state. 

On May 15, Rafiqul Islam, an NBR employee, has been temporarily suspended on charges of amassing a huge sum of money. 

Later, he went to the High Court division of the Supreme Court with the writ - challenging the relevant Section of the Sorkari Chakri Ain-2018. 

The High Court issued the rule after hearing the writ.
