The jail authorities do not need the copy of full verdict of the appellate division to execute war criminal Mohammad Kamaruzzaman, Attorney General Mahbubey Alam has opined.
He came up with the opinion following war criminal Kamaruzzaman family's visit to the central jail early in the morning. On Monday, Appellate Division of the Supreme Court sentenced him to death for crimes against humanity committed during the 1971 Liberation War.
The AG held a press conference at his office in the capital on Wednesday afternoon.
When asked if execution was possible without the full copy of the verdict, Mahbubey Alam said: “The tribunal has given its verdict against war criminal Mohammad Kamaruzzaman and the Appellative Division has upheld it.”
“In this case, does the jail authorities need the copy of the full verdict? According to my opinion, they only need the part which contains the death penalty order,” he said.
On May 9 last year, International Crimes Tribunal awarded death sentence to Kamaruzzaman for committing heinous crimes against humanity during the 1971 Liberation War. He appealed against the judgement after a month.
Talking about the previous Appellate Division verdicts, he said: “What was done in the previous case is not a big factor, one has to see what is in the law,” he said.
The attorney general also said the copy of the full verdict is not required to seek clemency.
“He [Kamaruzzaman] has to accept all his crimes and then seek for clemency,” he added.
“Those who talk about the scope of filling a review petition, I ask them to read Section 47 (K-3) of the constitution,” the attorney general said.
