'Impeachment authority belongs to the president'

The authority to impeach the judges has never been in the hands of the Jatiya Sangsad, it is not now and will never be in the future, Suranjit Sengupta, also the chairman of the parliamentary standing committee on Law, Justice and Parliamentary Affairs Ministry, has said.

Noting the parliament can impeach only one person that's the president, he said: “But it can't even impeach the Speaker not to speak of the judges of the Supreme Court as they are in the service of the government."

“The parliament does not give appointment and remove the judges as the President appoints and also removes them," he added.

Suranjit Sengupta mentioned these while speaking as the chief guest at a discussion in the city on Thursday, BSS reported.

Suranjit said: "The President can remove any judge if he/she is not able to conduct judgement and for his/her misconduct but the investigation committee will send the report regarding charges brought against him/her to the parliament.”

"If the two-thirds majority members of the parliament are unanimous on the investigation report then it will be sent to the President for action,” he added.

He said: “But the usual practice is that, if such allegation is brought against any judge, he/she furnishes resignation letter on his/her own initiative to the President. Every judge should be skilled and competent and then he/she will be respected as an independent judge."
