The High Court on Monday cleared the way for holding the election to the bifurcated Dhaka City Corporation (DCC) withdrawing its stay order on the process for holding the elections.
Justice Naima Haider and Justice Zafar Ahmed issued the order rejecting a writ petition filed challenging the schedule for holding the polls.
On April 16, 2012, an HC bench postponed for three months all actions of the Election Commission relating to holding of elections to the DCC, slated for May 24 last year.
It also issued asked the government to explain in two weeks why it should not be directed to hold DCC elections after the implementation of the prescribed election-related rules of Local Government (City Corporation) Act-2009, including delimitation of the DCC wards.
The HC also asked the EC to update the DCC electoral roll by that time. The HC division bench comprising of Justice AHM Shamsuddin Chowdhury and Justice Jahangir Hossain came up with the directives in response to a writ petition filed by Human Rights and Peace for Bangladesh, Later, it extended the stay order several times, reports banglanews.
Advocate Manzill Murshed appeared for the petitioner during the rule hearing, Advocate Shadin Malik stood for the EC and Deputy Attorney General Muklesur Rahman represented the state.
