10 cleared of custodial death charges

Ten accused persons, including five policemen and an Ansar member, were released yesterday from a case filed over the death of a rape-accused in police custody in Chittagong.

They are Sub-Inspector Amir Hossain of Panchlaish police station, Assistant Sub-Inspector Enyaet Hossain of Bakalia police station, Constables Mizanur Rahman, Moslem and Khokon Mia of Panchlaish police station, Ansar member Shahinur Alam, driver Akbar of Panchlaish police station, police informants Md Jamal and Humayun Kabir, and Harunur Rashid Duke, a local man.

The 10 were accused in the case filed over the death of a rape case accused, Md Rokonuzzaman, who was allegedly beaten to death in police custody in on June 19 last year.

Of them, Enyaet, Mizanur, Moslem, Khokon and Shahinur were suspended soon after the incident.

The CMP Detective Branch, which investigated the case, yesterday submitted the final report to the court of Metropolitan Magistrate Nur-e-Alam Bhuiyan mentioning that the accused had no involvement with the death of Rokonuzzaman, a local trader. The court accepted the report.

CMP’s Additional Deputy Commissioner (prosecution) Kazi Muttaki Ibn Minan said Investigation Officer Kusum Dewan, deputy commissioner of DB, found no involvement of the accused with Rokonuzzaman’s death.

According to the report, Rokonuzzaman died of a disease.

“The case is now legally ineffective,” said Muttaki, adding that the DB also enclosed two bonds of plaintiff Shimu Akhter, wife of Rokonuzzaman, with the report.

“Shimu in the bonds promised that she would not submit any plea expressing her discontentment with the report in the future and would never ask for any ruling on this either.”

The plaintiff could not be reached for comments despite repeated attempts.

On June 19 last year, 40-year-old Rokounuzzaman died in police custody after a police team picked him up from his residence on Syed Shah Road in Chittagong’s Bakalia area.

Family members said the police team, led by SI Amir, detained Rokunuzzaman saying he was an accused in a rape case.

Later, police informed the family members that Rokunuzzaman’s body was kept at the CMCH. But family members claimed that police beat Rokonuzzaman to death after he got on the police van.
