Cabinet files complaint against MP Nixon at Election Commission

The complaint letter states that Nixon threatened and defamed Faridpur district commissioner Atul Sarkar and others during the election

The Cabinet Division has filed a complaint against Faridpur 4 MP Mujibur Rahman Nixon Chowdhury to the Election Commission (EC) for violating  the Upazila Parishad (Election Code of Conduct) Rule 2016.

Tawhid Ilahi, Senior Assistant Secretary of the Cabinet Division, filed the complaint to the Election Commission secretary on Monday demanding action against MP Nixon Chowdhury, Upazila Chairman Mohammad Kauser and their supporters over the violation.

Dhaka Tribune obtained a copy of the complaint but when it tried to reach out to the Election Commission secretary on Monday evening, the latter did not receive the call.

The complaint letter issued by the cabinet division said that MP Nixon Chowdhury had threatened and defamed the Faridpur district commissioner, upazila nirbahi officer (UNO), executive magistrates and the local administration on the day of the election, the day before, and the day after.

The complaint letter also attached five pages of complaints forwarded from Faridpur.

According to UNB, Faridpur 4 MP Mujibur Rahman Nixon Chowdhury reportedly threatened the deputy commissioner (DC) of Faridpur district over the arrest of his supporters during the Charbhadrasan Upazila Parishad by-polls.

He made the threat at a victory rally held in front of Charbhadrasan Upazila Awami League office after Awami League candidate Md Kawsar Hossain was elected chairman of Charbhadrasan upazila.

Faridpur Deputy Commissioner Atul Sarkar is also the assistant commissioner (land) of the district.

Addressing the rally, MP Nixon said the deputy commissioner had arrested the activists of the boat symbol and used 12 magistrates to ‘assault them’ during the election.

Calling the deputy commissioner a “razakar”, the MP said: “Party leaders and activists were attacked by magistrates wherever they were found in four unions.”

"I warn the district administration. You’ve seen in Faridpur that many great leaders have fallen. The district administration staff was involved in illegal activities linked to Barkat-Rubel," the MP said.

If Barkat and Rubel could be tried, the deputy commissioner could also be tried as he got a share of Dipu Khan’s sand business, he added.

Warning the deputy commissioner, he said: “If I take my people in the movement against you, if I come with the leaders and activists after you, you won’t even get a chance to breathe.”

At this point in his speech, Nixon’s followers started chanting slogans and using slang against the deputy commissioner. “Do you do government jobs to make a BNP leader chairman?… Do you? We want justice,” said Nixon.

On the day of the election, Charbhadrasan Upazila Nirbahi Officer (UNO) Jasmine Sultana confirmed the MP’s use of abusive words against the DC, adding that the DC arrested the MP’s followers from an election booth as they were allegedly trying to smoke and cast fake votes.

However, sources seeking anonymity said the detainees were released as the MP had threatened the UNO over the phone.

The by-election to the post of chairman of Charbhadrasan Upazila Parishad was held on Saturday.

A total of seven candidates contested the election. Among them, two candidates withdrew their candidature before the election.

Awami League candidate and Upazila Awami League General Secretary Md Kawsar Hossain  was elected chairman, securing 16,528 votes.

Another candidate,  KM Obaidul Bari, former UP chairman of Harirampur Union Parishad, got 5,346 votes.

Magistrates were appointed in Charbhadrasan upazila elections as per the demand of the Election Commission to hold the election in a free, fair and peaceful environment, said Faridpur Deputy Commissioner Atul Sarkar.

Asked about Nixon’s threats, the DC said that he had informed the higher authorities of the matter.

Talking to Dhaka Tribune on Monday night, Election Commissioner Kabita Khanam said: "We have received the complaint from the Faridpur DC against the Faridpur 4 MP. But we have not received the complaint from the Cabinet Division yet.

"If they send it by Monday afternoon, probably we will get it on Tuesday."
