The Election Commission has no other option but to follow the High Court verdict on Bangladesh Jamaat-e-Islami’s registration, a commissioner said on Saturday.
“We must obey the High Court verdict regarding the Jamaat’s registration,” Election commissioner Mohammad Abu Hafiz told the Dhaka Tribune.
The High Court on Saturday released the full verdict on Jamaat’s registration pronounced on August 1. But the commission is yet to get the copy of the verdict, the commissioner said.
Jashim Uddin Sarker, legal affairs secretary of Jamaat-e-Islami, said if the EC says Jamaat-e-Islami is an illegal party, this would not be a mature statement.
He suggested that the EC should wait for the decision of the Appellate Division. “It is a split verdict and the judges have given permission for appealing to the Appellate Division against the verdict,” the Jamaat leader said.
Citing Article 103 of the constitution, he said: “It says the Appellate Division shall have jurisdiction to hear and determine appeals from judgements, decrees, orders or sentences of the High Court Division.”
