HC orders no arrest, harassment of ex-CJ Khairul Haque without specific charges

The High Court has directed authorities not to show former chief justice ABM Khairul Haque as arrested or harass him unless there is a specific case in which he is named as an accused.

The order, along with a rule, was issued on Sunday by a High Court bench comprising Justice Razik-Al-Jalil and Justice Debashish Roy Chowdhury following a hearing on a writ petition filed in this regard.

Senior lawyers Kamrul Haque Siddiqui, Sayeed Ahmed Raja, Mustafizur Rahman and Monayem Nabi Shaheen appeared for the petitioner during the hearing.

Earlier, on May 12, Justice Khairul Haque secured bail from the High Court in two murder cases filed over incidents that took place during the July mass uprising. Following the order, his lawyers said there was no legal barrier to his release from prison, as he had obtained bail in all cases against him. However, the state later filed an appeal with the Appellate Division seeking a stay on the order.

On April 28, the Appellate Division upheld Khairul Haque’s bail in cases related to the killing of a Jubo Dal activist during the July uprising, alleged forgery of the caretaker government verdict, and five cases filed by the Anti-Corruption Commission (ACC).

Earlier, on March 8, the High Court granted him bail in four cases after issuing a rule. He later secured bail in an ACC case on March 11. The state sought a stay on that bail order, but the Appellate Division dismissed the plea.

Subsequently, Khairul Haque was shown arrested in the murder cases of Arif filed with Jatrabari Police Station and Rubel filed with Adabor Police Station. After failing to secure bail from lower courts in those cases, he moved the High Court and obtained bail on May 12.

A total of seven cases have been filed against him.

On July 24, 2025, Khairul Haque was arrested from his residence in Dhanmondi, Dhaka. He was later shown arrested in the case over the killing of Jubo Dal activist Abdul Kaiyum Ahad in Jatrabari during the July mass uprising.
