A writ has been filed seeking the suspension of all activities related to the upcoming 13th parliamentary election.
Advocate Yarul Islam, secretary general of the registered political party Bangladesh Congress, filed the writ on Wednesday.
He said that the case is scheduled to be heard next week by a two-member bench headed by Justice Sikder Mahmudur Razi.
The writ challenges the appointment of the Election Commission secretary, returning officer, and assistant returning officer by the Executive Division, calling it illegal.
It also seeks a directive to form an independent “Electoral Service Commission” and requests a postponement of the next national parliamentary election until the matter is resolved.
According to the writ, the current election management by the Executive Division is inconsistent with the Constitution.
The Election Commission, as an independent institution like the judiciary, should have its own manpower.
The writ argues that giving the executive branch full responsibility for conducting elections leads to controversies, as the branch represents the government and acts according to its interests.
Advocate Yarul Islam said the government and the Election Commission are currently coordinating with district commissioners regarding election management.
He warned that if the same arrangement continues, elections could again be influenced by the executive.
He stressed that district and upazila election officers must be involved, and the Election Commission secretary should be removed to ensure a free and neutral election.
