HC questions legality of directly recording graft case at ACC

The High Court has issued a rule asking why the amended ACC rules for recording graft cases directly with commission and not with police station should not be declared unconstitutional and void.  

The bench of Justice Moyeenul Islam Chowdhury and Justice Khandaker Diliruzzaman issued the rule after hearing the writ petition in this regard on Tuesday. 

Advocate Abdul Kaium Khan accompanied by Momtaz Parvin stood for the writ while Advocate Kurshid Alam Khan represented the Anti-Corruption Commission.

Secretary of law, home, Parliament, chairman of the ACC, Inspector General of Police (IGP) and secretary of the ACC have been asked to come up with a reply within four weeks. 

According to the petition lawyer, ACC itself amended the ACC rules 2007, and published a gazette regarding the matter on June 20.  

On November 13, Supreme Court lawyer Subir Nandi Das and Nowsin Nawal filed the writ with the High Court challenging the amendment.
